Recently the U.S. Court of Appeals for Veterans Claims voted 2-1 in favor of veterans receiving both the Montgomery GI Bill and the Post 9-11 GI Bill for one enlistment term.

The Department of Veteran Affairs argued that this practice was put in place in order to prevent veterans from “double dipping” or duplicating benefits. The court found that the Veteran Affair’s practice of requiring veterans to relinquish their Montgomery GI Bill in order to obtain Post-911 benefits was improper. Veteran Affairs has not determined whether they will appeal the verdict.

Veteran Contributions

Veterans who came in under the Montgomery GI Bill had to contribute to the program in order to receive the benefit. However, there is no contribution required to receive the Post 9-11 GI Bill.  To get full Post 9-11 benefits veterans must have just served at least 36 months of active duty service after September 10, 2001.   If the ruling stands veterans will be able to receive an additional 12 months of GI Bill benefits under the Post 9-11 GI Bill.
